Chapter 4 ¼ – Building Codes and Permits
ADD:
SEC. 4 ¼-14 – Perimeter Privacy Fencing For Recreational Vehicle Parks And Trailer Parks
A. Applicability.
The provisions of this Section shall apply to any recreational vehicle park, RV park, trailer park, mobile home park, or similar development for which a permit is required by Cameron Parish, these provisions shall not be retroactive.
For purposes of this Section, the term “park” shall include any recreational vehicle park, trailer park, mobile home park, or similar development consisting of multiple spaces or sites intended for the placement or occupancy of recreational vehicles, travel trailers, mobile homes, manufactured homes, campers, or similar residential or temporary-living units.
B. Privacy Fence Required as Condition of Permit.
No permit subject to this Section shall be issued unless the applicant demonstrates compliance with the fencing requirements contained herein.
Except as otherwise provided in this Section, a park shall be enclosed by a continuous privacy fence having a minimum height of six (6) feet along each exterior boundary or property line of the property upon which the park is located.
The required fence shall be constructed and maintained so as to provide a substantially continuous visual barrier between the park and adjacent property.
A fence shall not be required along that portion of the property boundary that directly fronts upon or faces a public roadway providing access to the park.
C. Adjacent Property Owner Exception.
A privacy fence otherwise required along a boundary or property line under Subsection B shall not be required if the owner or owners of the property immediately adjacent to and sharing that boundary or property line provide written consent agreeing that the six-foot privacy fence need not be constructed along that boundary.
The written consent shall:
- Identify the recreational vehicle park, trailer park, or other development for which the permit is sought;
- Identify the adjacent property and the common property line or boundary for which the fencing requirement is being waived;
- Clearly state that the adjacent property owner consents to the applicant not constructing or maintaining the six-foot privacy fence otherwise required by this Section along the identified common boundary;
- Be signed by all record owners of the adjacent property sharing the boundary for which the exception is requested; and
- Be submitted to the Cameron Parish Permitting Department before issuance of the permit.
Consent from an adjacent property owner shall apply only to the common boundary shared with that property owner. Consent from one adjacent property owner shall not waive the fencing requirement along a boundary shared with any other property owner.
D. Multiple Adjacent Property Owners.
When one side or boundary of a park adjoins property owned by more than one person or entity, written consent must be obtained from each record property owner whose property shares any portion of the boundary for which the applicant seeks an exception.
If consent is obtained from fewer than all such property owners, the fencing exception shall apply only to the portion of the boundary adjoining the property of the owner or owners who have provided the required written consent.
E. Fence Specifications.
Any fence required by this Section shall:
- Be a privacy fence designed and constructed to substantially obstruct direct visibility through the fence;
- Have a minimum height of six (6) feet, measured from the finished grade immediately adjacent to the fence;
- Be constructed of wood, vinyl, composite material, masonry, or another durable material approved by the Cameron Parish Permitting Department that provides substantially equivalent privacy screening;
- Be constructed in a structurally sound and workmanlike manner;
- Extend continuously along each property boundary where fencing is required, except for gates, drainage structures, utility facilities, or other openings reasonably necessary for access or infrastructure; and
- Comply with all other applicable Parish ordinances, drainage requirements, utility easements, servitudes, roadway setbacks, and visibility requirements.
Chain-link fencing, livestock fencing, barbed-wire fencing, welded-wire fencing, or other open fencing shall not satisfy the requirements of this Section unless fitted with permanent screening materials approved by the Cameron Parish Permitting Department that provide a substantially continuous privacy barrier.
F. Roadway Frontage.
No fence shall be required under this Section along a property line that directly fronts upon a public roadway.
Where a park fronts upon more than one public roadway, the fencing exception contained in this Subsection shall apply to each exterior boundary that directly fronts upon a public roadway.
Nothing herein shall prohibit an owner or operator from voluntarily constructing a fence along a roadway frontage, provided that the fence complies with all applicable Parish ordinances, roadway setback requirements, visibility requirements, drainage requirements, and other applicable law.
G. Maintenance.
Any privacy fence required by this Section shall be continuously maintained by the owner or operator of the park in good repair and in a condition sufficient to serve as a six-foot visual and physical privacy barrier.
Missing, broken, leaning, substantially damaged, or deteriorated fence panels or sections shall be repaired or replaced within a reasonable time after notice from Cameron Parish.
Failure to construct or maintain a required privacy fence shall constitute a violation of this Section.
H. Continuing Condition of Permit.
Compliance with this Section shall constitute a continuing condition of any permit issued for a park.
An owner or operator shall not remove, reduce in height, materially alter, or replace a fence required under this Section with a noncompliant fence unless:
- A replacement fence complying with this Section is constructed; or
- The owner or operator obtains the written consent of the adjacent property owner or owners in the manner provided by Subsection C and submits such written consent to the Cameron Parish Permitting Department.
I. Permit Application Requirements.
Every permit application subject to this Section shall include a site plan or survey sufficient to identify:
- The exterior boundaries of the property;
- All public roadway frontage;
- The proposed location of all required six-foot privacy fencing;
- Any boundary for which the applicant seeks an exception based upon adjacent-property-owner consent; and
- The ownership of property immediately adjacent to any boundary for which an exception is requested.
Any written consent relied upon by the applicant shall be submitted with the permit application or before final approval of the permit.
J. Enforcement and Penalties.
No permit shall receive final approval until the privacy fencing required by this Section has been installed, unless the Cameron Parish Permitting Department authorizes installation to occur at a later stage of development before occupancy or operation of the park.
No recreational vehicle park, trailer park, or other development subject to this Section may commence operation or occupancy until the required six-foot privacy fencing has been installed or the required written adjacent-property-owner consent has been submitted and accepted by the Cameron Parish Permitting Department.
A violation of this Section shall constitute a violation of the Cameron Parish permitting ordinances and shall be subject to the penalties and enforcement provisions otherwise applicable to violations of the Cameron Parish Code of Ordinances.
